Welcome to BrushMind

These Terms of Service ("Terms") govern your use of the BrushMind mobile application ("App") operated by BrushMind ("we," "us," or "our"). By downloading, installing, or using our App, you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years old to use BrushMind. If you are between 13 and 18 years old, you must have your parent or guardian's permission to use the App. By using BrushMind, you represent that you meet these age requirements.

2. Account Creation and Management

  • You can create an account using email, Google, Apple, or X (Twitter) authentication
  • You are responsible for maintaining the confidentiality of your account credentials
  • You must provide accurate and complete information during registration
  • You may delete your account at any time through the Account Settings
  • We reserve the right to suspend or terminate accounts that violate these Terms

3. AI Image Generation Service

  • BrushMind uses artificial intelligence to generate images based on your drawings and prompts
  • AI-generated content may not always be accurate, appropriate, or free from bias
  • You are solely responsible for reviewing and using AI-generated content appropriately
  • Generated images may reflect limitations, biases, or errors inherent in AI technology
  • We do not guarantee the quality, accuracy, or suitability of generated content for any purpose

4. Content Ownership and Licensing

  • You retain ownership of your original drawings and uploads
  • You retain ownership of AI-generated images created from your content
  • By using our service, you grant BrushMind a non-exclusive, worldwide license to process, store, and display your content solely for providing the service
  • This license allows us to process your uploads through our AI generation system and display results to you
  • You may download, share, or use your generated images as you wish, subject to applicable laws

5. Intellectual Property

  • BrushMind owns all rights to the App, including software, design, trademarks, and underlying AI technology
  • Our AI models and generation algorithms are proprietary technology
  • You may not copy, modify, distribute, or reverse engineer any part of our service
  • "BrushMind" and related logos are our trademarks

6. Payments and Credits

  • BrushMind operates on a credit-based system for image generation
  • Credits can be purchased through in-app purchases via Apple App Store, Google Play, or Stripe
  • All purchases are final and non-refundable once credits are used
  • Unused credits do not expire but may be forfeited if your account is terminated for violations
  • Prices are subject to change with notice
  • Refunds may be available for unused credits within 14 days of purchase, subject to platform policies
  • Chargebacks or payment disputes may result in account suspension

7. Prohibited Content

You may not upload or generate:

  • Illegal, harmful, or dangerous content
  • Adult, sexual, or explicit content
  • Content that promotes violence, hatred, or discrimination
  • Content that infringes on others' intellectual property rights
  • Content that impersonates others or spreads misinformation
  • Content that violates any applicable laws or regulations

Violations may result in immediate account termination.

8. Service Limitations

  • BrushMind is provided "as is" without warranties of any kind
  • We do not guarantee 100% uptime or uninterrupted service
  • Service may be temporarily unavailable due to maintenance, updates, or technical issues
  • We may modify, suspend, or discontinue features at any time
  • Generation times may vary based on system load and complexity

9. Limitation of Liability

  • BrushMind's liability is limited to the maximum extent permitted by law
  • We are not liable for any indirect, incidental, or consequential damages
  • Our total liability shall not exceed the amount you paid for credits in the last 12 months
  • You use the service at your own risk

10. Termination

  • You may terminate your account at any time through Account Settings
  • We may terminate or suspend your account for violations of these Terms
  • Upon termination, your access to the service will cease
  • Unused credits may be forfeited upon termination for violations

11. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes through the App or by email. Continued use of the service after changes constitutes acceptance of the new Terms.
